UCIDCAT announces that it can now celebrate marriages with civil validity in which the woman needs the authorization of a guardian.

La Unió de Comunitats Islàmiques de Catalunya ha anunciat (en castellà) a les seves xarxes socials that ja està homologada per celebrar matrimonis islàmics amb efectes civils. L’entitat presenta el servei com a “matrimonio islámico con efectos civiles” perquè ha aconseguit l’homologació perquè la cerimònia tingui validesa davant el Registre Civil.

La dona necessita un tutor que l’autoritzi

Més enllà dels requisits civils habituals —majoria d’edat, identificació, certificat de naixement, estat civil o capacitat matrimonial—, el cartell introdueix condicions pròpies del matrimoni islàmic. I aquestes condicions no són menors: dibuixen una cerimònia on l’home i la dona no compareixen en un pla d’igualtat. L’home compareix com a subjecte ple, adult i autònom. La dona necessita la presència física o en línia d’un tutor que l’autoritzi.

Un altre element propi del matrimoni islàmic que hi apareix és la dot. En la formulació islàmica, aquesta dot és una quantitat de diners o un bé que el marit entrega o es compromet a entregar a la dona. Pot ser simbòlica, pactada entre les parts i presentada com una garantia econòmica per a ella. Però el fet que continuï formant part del procediment reforça una concepció del matrimoni molt allunyada de la igualtat moderna on l’home mai entrega diners a canvi de la dona.

Així, el matrimoni anunciat per UCIDCAT combina requisits civils amb condicions religioses específiques: dot, testimonis, condició musulmana del marit i dels testimonis, i presència del tutor de l’esposa. El resultat és una cerimònia religiosa amb efectes civils en què l’home actua com un adult i la dona no. Fins i tot si una dona no musulmana es casa amb un musulmà, haurà de portar un home que doni el consentiment. Això significa que a Catalunya es pot celebrar un matrimoni amb efectes civils en què la dona compareix tutelada.
