La mestra musulmana Hadija Amajoud ha acabat perdent la feina després de tres anys de conflicte amb l’administració educativa de Flandes Oriental per negar-se a treure’s el hijab mentre feia classe. La dona treballava des del 2022 en una escola i s’ha mantingut ferma malgrat els expedients disciplinaris, els procediments judicials i la norma provincial que prohibeix al personal exhibir símbols religiosos o ideològics visibles. Segons The Brussels Times, la mestra rebutja la norma perquè defensa que el vel «forma part de qui és». La seva negativa ha acabat tenint conseqüències: aquest 14 de setembre, la província de Flandes Oriental ha decidit acomiadar-la per negar-se a treure’s el hijab durant la jornada laboral, segons informa HLN.

La prohibició explícita de portar símbols religiosos per al personal docent provincial de Flandes Oriental va entrar en vigor l’1 de setembre de 2024. El reglament obliga el personal a mostrar neutralitat i prohibeix portar símbols religiosos o ideològics visibles, excepte els docents d’assignatures confessionals. El maig de 2025, la província va ampliar aquesta línia també als alumnes, reforçant una política de neutralitat que contrasta amb altres zones de Bèlgica.

Ja portava hijab quan la van contractar

La dona va començar a treballar al centre el setembre del 2022 i ja portava hijab. Durant aproximadament un any va fer classe així sense que l’escola li ho impedís. El conflicte va començar el setembre del 2023, quan la direcció li va comunicar que el vel no encaixava amb la política de neutralitat que la província volia aplicar al personal docent. Tres anys després el continuava portant.

El problema per a l’escola l’any 2023 era que no existia encara una prohibició general prou clara. Li van obrir un procediment disciplinari però es va aturar perquè el codi deontològic utilitzat no cobria correctament el personal docent subvencionat. La província va reaccionar modificant el reglament per tancar totes les escletxes perquè entrés en vigor el setembre de 2024. Això tampoc la va fer canviar d’actitud. Segons la musulmana, no li afectava la prohibició perquè la van contractar dos anys abans de la norma. Però la posició de la província era clara: les condicions de treball poden canviar i el personal s’ha d’adaptar a les normes vigents.

La justícia avala la prohibició de fer classes amb el mocador

Abans que el conflicte arribés als tribunals ordinaris, la professora va portar el cas davant l’Institut Flamenc de Drets Humans. La seva Cambra de Litigis va dictar resolució l’11 de desembre de 2025 i va donar àmpliament la raó a la mestra. Tot i això, les autoritats de Flandes van anar als tribunals ordinaris.

El maig del 2026, el Tribunal de Primera Instància de Gant va rebutjar les reclamacions de la mestra i va donar la raó a la província. La sentència va considerar que la norma general no havia estat creada específicament contra ella i que el personal docent s’ha d’adaptar a les regles vigents. Malgrat la sentència, la docent va continuar presentant-se a classe amb hijab després de reincorporar-se d’una baixa. Això va obrir un nou procediment disciplinari i la resolució ha estat l’acomiadament.

El 3 de setembre de 2026, Amajoud va comparèixer davant el comitè disciplinari de la província, que va deixar la decisió pendent de deliberació. Onze dies després ha arribat el desenllaç: Flandes Oriental ha decidit acomiadar-la. La professora, per tant, ha mantingut la seva negativa a treure’s el hijab fins a perdre la feina. El sindicat ACOD ja ha anunciat que recorrerà la decisió, de manera que la batalla legal encara no s’ha acabat.
