Anger in Sweden over judge Mohamed Ali for not deporting rapist of 100-year-old grandmother

Segons ha publicat el diari suec Expressen, la justícia sueca ha condemnat a quatre anys de presó el ciutadà iraquià Shakir Mahmoud Shakir, de 38 anys, per la violació d’una dona de 100 anys a Estocolm. Tot i la gravetat dels fets, el tribunal ha decidit no expulsar-lo del país, una resolució que ha desencadenat una forta reacció política i social a Suècia. La sentència el condemna a quatre anys de presó i desestima l’expulsió demanada pel fiscal. El jutge argumenta que Shakir porta molts anys a Suècia i té un fill. «Són circumstàncies molt fortes«, va escriure.

La víctima és una dona centenària que vivia sola i rebia serveis d’atenció domiciliària. Va començar a sentir dolors intensos al pit i va activar el sistema d’emergències. En lloc del personal sanitari, però, qui va arribar al seu domicili va ser Shakir Mahmoud Shakir, que treballava en el servei d’assistència a domicili.

Qui l’havia d’ajudar la va agredir

Segons va explicar la dona en els interrogatoris policials, quan l’home va arribas li va dir que “havien dit que l’havien d’untar” i portava amb ell una crema. Amb aquest pretext, va iniciar l’agressió sexual. La víctima va relatar que l’home li va introduir un objecte al cos i que ella va reaccionar immediatament cridant-li que parés i preguntant-li què estava fent.

Malgrat aquestes protestes, l’agressió va continuar. La dona va estimar que els fets es van allargar uns deu minuts abans que l’home abandonés el domicili. Posteriorment, davant la policia, va descriure l’estat en què va quedar després de l’agressió, explicant que estava plorant desconsoladament i que no podia entendre com una persona que treballava al servei d’ajuda podia fer una cosa així.

Antecedents i una altra possible violació

A més del cas pel qual ha estat condemnat, Shakir Mahmoud Shakir havia estat investigat per una segona presumpta violació, aquesta vegada contra una dona de 94 anys. El tribunal, però, el va absoldre d’aquest segon delicte en considerar que les proves no permetien superar el llindar necessari per a una condemna penal, tot i que els fets també s’haurien produït en el marc de l’atenció a persones grans.

El condemnat tampoc era un desconegut per al sistema judicial. Segons recull Expressen, Shakir Mahmoud Shakir havia estat condemnat anteriorment per falsificació de documents i usurpació de funcions públiques, delictes pels quals ja havia complert pena. Aquest mateix any, les autoritats li havien retirat el permís de conduir durant dotze mesos després de ser interceptat conduint amb narcòtics a la sang.

El Primer Ministre no està d’acord

La decisió judicial ha provocat reaccions immediates a escala política. El primer ministre suec, Ulf Kristersson, va escriure a la xarxa X que una persona que no és ciutadana sueca i comet “actes tan terribles” ha esgotat el seu dret a quedar-se al país. En el mateix missatge, va afirmar que “aquest tracte indulgent amb criminals greus ha de cessar” i va assegurar que el seu govern impulsarà una legislació més estricta en matèria d’expulsió d’estrangers condemnats per delictes greus.
