França prohibeix definitivament el burkini a les piscines municipals

L’Ajuntament ecologista de Grenoble va voler obrir una excepció per permetre el burkini. Ara, la justícia confirma que les piscines municipals no poden adaptar-se a una reivindicació religiosa.

L’Ajuntament de Grenoble, controlat pels Verds, va obrir la porta al burkini el maig del 2022 mitjançant una modificació del reglament de les piscines municipals. El text canviava l’article 10 per permetre peces de bany “no ajustades”. Darrere d’aquesta terminologia administrativa hi havia un objectiu molt concret: permetre l’ús del burkini. La polèmica va créixer ràpidament a tot França i el prefecte d’Isère va demanar l’anul·lació de la decisió, al·legant un “greu atac als principis de la laïcitat”.

La maniobra va durar poc. El Tribunal Administratiu de Grenoble va suspendre el nou reglament pocs dies després i el cas va arribar ràpidament al Consell d’Estat, la màxima instància administrativa francesa. El juny del 2022, aquest tribunal va confirmar la suspensió i va establir el criteri central del cas: una piscina municipal no pot adaptar les seves normes comunes per satisfer una reivindicació religiosa concreta. Des d’aleshores, el burkini ja havia quedat fora de les piscines de Grenoble; el que faltava era la decisió definitiva sobre el fons de l’assumpte.

La justícia tanca l’escletxa oberta per Grenoble

Malgrat que el Consell d’Estat ja havia deixat clar el criteri el 2022, la batalla judicial no estava del tot tancada. Faltava la decisió sobre el fons del cas. Le Figaro explica que aquesta decisió ha arribat ara: el Tribunal Administratiu de Grenoble ha anul·lat definitivament l’article del reglament que permetia de fet banyar-se amb burkini a les piscines municipals.

Segons el tribunal, el problema era el “caràcter altament específic i fortament excepcional” de la mesura. La norma creava un “tracte desigual” respecte dels altres usuaris “sense cap justificació real” i podia afectar tant el bon funcionament del servei públic com la “igualtat de tracte dels usuaris”. Per això els jutges han ordenat l’anul·lació de l’article 10 i han tancat definitivament l’escletxa que l’Ajuntament de Grenoble havia intentat obrir per permetre el burkini.
