França fa un pas més: prohibeix el vel a les advocades als tribunals

El Consell d’Estat confirma la normativa que impedeix als advocats portar signes religiosos durant les seves intervencions a sala.

El 3 de març de 2025, el Consell d’Estat francès ha validat la prohibició del vel per a advocades quan intervenen als tribunals. Ho ha informat el portal Bladi.net, citant la decisió judicial que dona suport a la norma del Consell Nacional dels Col·legis d’Advocats (CNB), en vigor des del setembre del 2023.

L’argument central del CNB és la necessitat de garantir la neutralitat del sistema judicial. En aquest sentit, la presència de símbols religiosos visibles —ja sigui un vel, una creu o qualsevol altre distintiu— s’interpreta com una possible interferència en la percepció d’imparcialitat de la justícia.

Advocades musulmanes critiquen la decisió

Diverses advocades musulmanes han denunciat que la mesura suposa una vulneració de drets i una discriminació indirecta, ja que afecta especialment les dones musulmanes que porten hijab. Algunes veus consideren que es tracta d’un pas més cap a l’exclusió d’aquest col·lectiu de determinats espais de representació pública.

“Ens diuen que tenim dret a exercir com a advocades, però no tal com som. Ens demanen que triem entre la nostra professió i la nostra identitat”, ha declarat una lletrada afectada en declaracions recollides per mitjans francesos.

La decisió s’inscriu en un context més ampli on França manté una política estricta de laïcitat (laïcité), que defensa la separació clara entre religió i institucions públiques. Tot i això, cada nova regulació vinculada a la visibilitat de l’islam genera debat, especialment entre defensors dels drets humans i sectors progressistes que alerten sobre la islamofòbia institucional.
