Un jutge del Canadà ha d’aclarir que la fotografia d’una dona musulmana sense vel no és la d’una dona despullada

La dona sostenia que les imatges d’abans de ser musulmana han d’estar protegides per la llei perquè son “com sortir despullada”. De la fotografia fent-se un petó amb el seu exmarit diu que és sexual.

El Tribunal de Resolució Civil de la Colúmbia Britànica del Canadà ha dictaminat que unes fotografies d’una dona musulmana sense portar el vel islàmic (hijab) no poden ser considerades “imatges íntimes” sota la legislació vigent a la província.

La demandant va portar el cas davant la justícia perquè el seu exmarit havia distribuït fotografies d’ella sense portar el vel islàmic. En les imatges apareixia amb el cabell descobert i amb braços i espatlles visibles perquè eren d’abans de la conversió a l’islam. Segons la dona, aquestes fotografies adquirien un caràcter íntim un cop havia adoptat el vel com a pràctica religiosa, atès que mostrar-se sense hijab davant d’homes no emparentats contradeia les seves creences. Per això, va sostenir que la difusió no consentida d’aquestes imatges l’havia danyada greument i que la llei provincial li havia d’oferir protecció.

El tribunal no la veu quasi despullada per no portar hijab

En la seva resolució, el Tribunal de Resolució Civil de la Colúmbia Britànica va desestimar la reclamació. Segons recull CTV News Vancouver, el tribunal va assenyalar que les fotografies “no compleixen els requisits legals per ser considerades imatges íntimes” . Tal com recull la decisió, el jutge va afirmar: “Considero que les imatges de la sol·licitant sense el seu hijab no la mostren com a “gairebé nua”.

Amb aquesta frase, el tribunal subratlla que la simple absència del hijab no equival legalment a estar nua o gairebé nua, condició indispensable perquè una imatge pugui ser considerada íntima sota la Intimate Images Protection Act.

El jutge sembla que ho tenia molt clar. Va afegir que “les percepcions subjectives de vergonya o incomoditat cultural no poden alterar la definició legal establerta per la legislació”. En conseqüència, va rebutjar la petició de la dona i va concloure que les imatges no estaven protegides per la llei.

Un petó no és un acte sexual

A la seva demanda, la dona també va al·legar que algunes de les fotografies on apareixia fent-se un petó amb el seu aleshores marit havien de ser considerades “imatges íntimes”, ja que, segons ella, un petó constitueix un acte sexual.

El tribunal, però, també va rebutjar aquest argument. En la resolució s’hi especifica que un petó, fins i tot si és en un context de parella, no equival a un acte sexual en el sentit legal. Aquesta normativa protegeix únicament les imatges que mostren relacions sexuals o conductes explícitament sexuals, no gestos d’afecte o mostres d’afecte físic com els petons o les abraçades.

En conseqüència, el CRT va concloure que tampoc aquestes fotografies podien ser qualificades com a “imatges íntimes” i, per tant, no gaudien de la protecció prevista a la llei.
