On October 1st, the trial against Custodio Ballester, a priest from Barcelona, will begin in Malaga, following an article entitled “The impossible dialogue with Islam”. According to the Prosecutor's Office, the text contains expressions that may incite hatred against the Muslim community and, for this reason, requests a sentence of three years in prison.

The prosecution claims that Ballester uses generalizations that present Islam as a threat to Western civilization. The problem for the Prosecutor's Office is that these words, spoken by someone with moral authority like a priest, can have a wide and dangerous impact. The article was a response to a pastoral letter from Cardinal Juan José Omella entitled “"The necessary dialogue with Islam"”. For Ballester, Omella's mistake is that "«assume as a starting point that all religions are equal«.

Ballester says that "Islam does not allow dialogue"«

The origin of the controversy lies in this article from 2016. In the text, Ballester stated things like: “Islam does not allow dialogue. Either you believe, or you are an infidel who must be subdued one way or another.” He also said that Islam “with one hand he promotes works of charity, while with the other hand he arms himself to annihilate all those who refuse to recognize Allah...”. The article also said that "«In countries where Muslims hold power, Christians are brutally persecuted and murdered.«. while Christianity never endorses murder with dogma.

Ballester argues that his article was not aimed at all Muslims, but only at a radical and violent version of Islam. In recent statements, he has stated that “I know Muslims who haven't felt offended because they have understood perfectly well that I wasn't referring to them, but to those who live Islam in a violent, radical way..”.

According to a recent report by’The Debate, the Association Muslim women against Islamophobia, directed by Ibrahim Miguel Ángel Pérez, is the one who filed the complaint that led to the process. This entity receives funding from the Barcelona City Council for the organization of events and conferences, as well as the Generalitat of Catalonia.

Ibrahim Miguel Ángel Pérez is a convert to Islam, formerly linked to the political movement Barcelona en Comú. His partner, Afifa Azzouzz, who chairs the platform, also comes into play. The entity's assets also include lawyer Zoubida Barik, who has appealed to international bodies (Strasbourg) in cases related to the rights of Muslim women, such as the use of the religious veil.

The Prosecutor's Office, headed by María Teresa Verdugo, accuses him of hate crime for the content of this article. The charges were initiated in 2020. According to the indictment, the text goes beyond legitimate criticism and promotes a generalized and negative image against Muslims, associating them with violence and the destruction of Christian civilization.
