Quebec prohibeix que les mares musulmanes facin voluntariat a les escoles amb el hijab

La legislació sobre laïcitat del Quebec s’estén més enllà del personal docent i treballadors i ara afecta també els pares que participen en activitats escolars.

El Quebec ha fet un pas més en la seva política de laïcitat i ha començat a aplicar sense excepcions la prohibició de símbols religiosos dins l’àmbit escolar, incloent-hi també els pares voluntaris. Segons una informació publicada per Global News, les escoles ja impedeixen l’accés a mares voluntàries amb mocador.

Aquesta mesura s’emmarca en una línia política que el Quebec aplica des de fa anys en nom de la laïcitat. El 2019, el govern va aprovar una llei que prohibia als professors portar símbols religiosos durant la seva feina. Posteriorment, l’any passat, aquesta restricció es va ampliar a tot el personal dels centres educatius amb l’anomenada «Llei 94». Ara, ha arribat el torn als pares voluntaris que fan tasques com acompanyar sortides escolars, ajudar a la biblioteca, donar suport en activitats de lectura o col·laborar en festes i tallers dins del centre.

Treballadores prefereixen dimitir a treure’s el hijab

El rumb del govern del Quebec és clar: reduir al màxim la presència visible de símbols religiosos dins l’escola pública. El nou marc normatiu aprovat l’octubre de 2025 amb la Llei 94 va estendre la prohibició als estudiants i a tot el personal escolar. Segons dades recollides per CBC News, treballadores escolars com monitores de menjador, d’extraescolars, cuineres o conserges han preferit no treballar a treure’s el seu símbol religiós. Algunes han optat per dimitir i altres han estat acomiadades per negar-se a complir la llei.

Tot i això, el govern manté el criteri i defensa que l’escola pública ha de funcionar com un espai completament neutral, on qualsevol expressió religiosa visible queda fora de l’àmbit educatiu. El ministre d’Educació i impulsor de la llei, Bernard Drainville, ho resumeix de manera contundent: “Van decidir no respectar la llei i, per tant, és la seva decisió. Han d’assumir les conseqüències de la seva pròpia elecció personal”. Una posició que evidencia la voluntat del govern de portar la laïcitat fins a les últimes conseqüències.

Professors amb drets adquirits; la resta, no

El Quebec ha aplicat la seva política de laïcitat amb una estratègia gradual i molt definida. Amb l’aprovació de la llei 21 el 2019, el govern va introduir una clàusula de drets adquirits per evitar una ruptura immediata dins del sistema educatiu: els professors que ja treballaven en aquell moment van poder mantenir els seus llocs encara que portessin símbols religiosos. En canvi, tots els nous docents han d’ajustar-se a la norma des del primer dia si volen accedir a l’escola pública.

Ara bé, aquesta excepció no implica plena llibertat. Els docents amb drets adquirits poden continuar exercint, però tenen limitada la seva mobilitat dins del sistema: no poden canviar de centre ni accedir a promocions si no renuncien als símbols religiosos. El model, per tant, permet la continuïtat dels casos existents però impedeix que aquesta situació es perpetuï o s’estengui amb el temps.

Amb la Llei 94, el govern ha eliminat qualsevol marge d’excepció per a la resta de personal escolar i per als voluntaris. Monitors, personal de menjador, conserges o pares i mares que col·laboren als centres han de complir íntegrament la norma sense cap protecció transitòria.

Una nova llei més estricta en camí…

Lluny d’aturar-se, el govern del Quebec continua avançant en el reforç del seu model de laïcitat amb noves mesures i projectes legislatius. En els darrers mesos ja ha fet passos addicionals, com la prohibició de l’ús de símbols religiosos en la publicitat institucional —després de la polèmica per una imatge d’una nena amb hijab en una biblioteca de Montreal— i la l’eliminació de les sales d’oració en edificis públics, incloent-hi centres educatius i universitats.

Ara, el govern vol ampliar les restriccions amb la Llei 9 per prohibir el hijab, altres símbols religiosos i el menjar halal a les escoles bressol públiques i centres educatius subvencionats. De moment, aquests secors han quedat al marge de les prohibicions però pel ministre de laïcitat, Jean-François Roberge, cal l’ampliació per mantenir la coherència.

Amenaça d’èxode musulmà del Quebec

L’enduriment del marc legal en matèria de laïcitat ja està generant reaccions entre una part de la població musulmana. Diversos testimonis recollits en mitjans es plantegen abandonar el Quebec, bé per tornar al seu país d’origen o per traslladar-se a altres províncies del Canadà. Argumenten que les noves lleis, especialment les que limiten l’ús del hijab en àmbits clau, han creat un clima que perceben com menys favorable a la visibilitat religiosa.

Aquest malestar també ha estat documentat per altres mitjans canadencs. Reportatges de The Walrus recullen casos de dones que han renunciat a carreres en el sector públic davant la impossibilitat de treballar amb hijab, mentre que informacions de CityNews Montreal apunten que una part significativa de dones musulmanes ha considerat abandonar el Quebec per motius laborals.
