El nen va declarar que el seu pare «és capaç de parlar amb ell sobre l’islam, sobre la cultura pakistanesa i la seva pròpia educació». Com que el pare té un paper clau en la formació religiosa del menor la seva expulsió impediria transmetre-li els valors de l’islam.

Set condemnes i 21 delictes

L’home, de nacionalitat pakistanesa, acumula un total de set condemnes per un total de 21 delictes comesos entre 2006 i 2020. S’inclouen condemnes per tràfic de drogues com l’herïna i la cocaïna. Malgrat aquest historial penal, el tribunal va considerar que deportar-lo vulneraria els seus drets, especialment pel que fa a la relació amb el seu fill de 13 anys, nascut al Regne Unit.

El tribunal va tenir en compte que l’home havia viscut al Regne Unit durant 26 anys i no havia comès cap delicte en els darrers 10.
