Un institut de Logroño prohibeix el hijab

L’institut Sagasta ha fet valer el reglament intern per prohibir portar res al cap, inclòs el vel islàmic. La Conselleria d’Educació de La Rioja diu que respecta l’autonomia dels centres.

L’inici del curs escolar a l’Institut Sagasta de Logroño ha estat marcat per la polèmica després que diverses alumnes fossin impedides d’accedir al centre per portar hijab. La direcció es remet al Reglament d’Organització i Funcionament (ROF), que prohibeix cobrir-se el cap dins les instal·lacions.

La mesura va ser votada al claustre i la Consejería d’Educación de La Rioja que defensa l’autonomia dels centres per establir les seves normes internes. La mesura ha provocat una onada de crítiques d’associacions i entitats socials, que alerten d’una vulneració del dret a la llibertat religiosa. També es queixen de que ningú els va informar i s’ho han trobat el primer dia de curs.

Les associacions islàmiques es queixen

La notícia de RTVE es centra en les crítiques a la mesura. Explica que un ampli bloc d’associacions, incloent ATIM, AMIN, Arabella, la Asociación Paquistaní de La Rioja, Faizan e Madina i Gulzare Madina, ha emès un comunicat conjunt condemnant la mesura com una vulneració de drets fonamentals: la Constitució, la Llei Orgànica de Llibertat Religiosa, la Declaració Universal dels Drets Humans i el Conveni Europeu de Drets Humans

En el comunicat, denuncien que “el hijab no tapa la cap, tan sols cobreix el cabell i les orelles”, i fan una crida a les institucions perquè garanteixin un marc clar i equitatiu, evitant mesures arbitràries entre diferents centres

Les associacions també al·ludeixen a la manca de comunicació prèvia a les famílies: la decisió es va prendre a finals del curs passat, però els pares no en van ser informats, impedint que les alumnes haguessin cercat plaça en altres centres infobaeelDiario.es. A més, denuncien que en dos instituts de Calahorra s’ha produït una situació similar, obligant les estudiants a canviar de localitat per poder portar hijab

El precedent de Madrid

A la Comunidad de Madrid ja hi ha tres instituts que han prohibit el vel islàmic, concretament a Parla. Dos més s’ho plantegen però encara no han pres la decisió. En aquella ocasió, es van produir manifestacions de dones musulmanes i gent d’esquerres sota el lema «mi hijab, mi libertad». La conselleria de Madrid va fer com la de La Rioja i es va abstenir de fer perquè considera que els centres tenen autonomia per prendre aquestes decisions.

Els centres de Madrid van donar explicacions com que el hijab es pot fer servir per copiar als exàmens o que els treu autoritat quan demanen a altres alumnes que no portin gorra.

La disparitat entre diferents instituts evidencia la falta d’un criteri unificat a nivell autonòmic o estatal. Per aquest motiu, les professores Sonia Sierra i Elena Ramallo van presentar iniciatives legislatives al Congreso de los Diputados per prohibir-ho però no han prosperat. A La Rioja o Madrid els centres poden prohibir el hijab perquè les seves conselleries d’Educació consideren que entra dins l’autonomia dels centres. Ara bé, això és discutible legalment, ja que el Tribunal Suprem ha deixat clar que només una llei orgànica pot limitar drets fonamentals com la llibertat religiosa.
